1. About These Terms
These Kilomarket Terms of Service govern the use of the Kilomarket website and the purchase or use of services provided by Kilomarket Pvt Ltd (“Kilomarket”, “we”, “us” or “our”).
Kilomarket Pvt Ltd is a company registered in Zimbabwe under registration number 3783/2021 and operating from Office 103, First Floor, Rothbart Building, Sixth Street, Gweru.
Kilomarket provides web design, graphic design, branding, printing, promotional materials and related business services. Hosting and business email services may be provided under Kilohost while social media management services may be provided under SAKA. Unless a quotation identifies a different contracting party, these services remain provided by Kilomarket Pvt Ltd.
By using our website, accepting a quotation, placing an order, paying a deposit or authorising us to begin work, you agree to these Terms.
If a written quotation, proposal, invoice or service agreement contains terms that differ from these general Terms, the specific written document will take priority for that particular order.
Nothing in these Terms limits any rights that cannot lawfully be excluded under Zimbabwean law.
2. Eligibility and Authority
You must have the legal capacity to enter into an agreement with Kilomarket.
If you place an order on behalf of a company, church, school, organisation or another person, you confirm that you have authority to approve the work and bind that customer to the agreement.
We may ask for confirmation of authority before beginning or releasing work.
3. Quotations and Orders
Our services are provided according to a written quotation, proposal, invoice or other agreed description of work.
A quotation will be valid for the period stated on it. If no period is stated, it will remain valid for 14 days unless we withdraw or revise it before acceptance.
A quotation covers only the services, quantities, sizes, pages, functions, materials, revisions and deliverables specifically listed in it. Any additional work may require a revised quotation or an additional charge.
An order becomes confirmed when:
- The customer accepts the quotation or proposal
- The required deposit or full payment is received
- The customer supplies the information, content and approvals needed for the work
- Kilomarket confirms that the order has been accepted
We may refuse work that is illegal, fraudulent, misleading, abusive, discriminatory, harmful or likely to infringe another person’s rights.
4. Prices and Payment
All prices are in United States dollars unless the quotation states otherwise.
Most custom design, branding and website projects begin with a 50% deposit. The balance is normally payable when the work is completed and before the final files, website access or finished products are released.
Printing, domains, hosting, advertising, materials and other services involving advance third-party costs may require full payment before work begins.
The exact payment requirements for each order will be stated in the quotation or invoice.
Payments must be made using one of the methods shown on the invoice or confirmed by Kilomarket. Customers are responsible for any bank, transfer or payment-processing charges unless otherwise agreed.
Kilomarket may pause work, withhold final files, suspend a service or delay collection and delivery where an agreed payment is overdue.
Ownership or usage rights in final work do not transfer until all amounts due for that work have been paid.
5. Customer Responsibilities
The customer must provide accurate, complete and lawful information required to complete the work.
This may include:
- Correct names, telephone numbers, addresses and contact details
- Final text, photographs, logos and brand information
- Website content and account access
- Product details, dimensions and quantities
- Timely feedback, corrections and approvals
The customer confirms that they own or have permission to use all text, photographs, logos, music, videos, trademarks and other material supplied to Kilomarket.
Kilomarket is not responsible for claims arising from material supplied or specifically requested by the customer. The customer agrees to assist Kilomarket and cover reasonable losses or costs arising from a third-party claim caused by unlawful or infringing material supplied by the customer.
Customer delays may extend the expected completion date. Kilomarket is not responsible for delays caused by missing content, late feedback, changing instructions or failure to provide required access.
6. Timelines and Turnaround
Any completion or delivery date is an estimate unless Kilomarket confirms in writing that it is a fixed deadline.
The turnaround period begins only after:
- The required payment has been received
- All required content and instructions have been supplied
- The project scope has been confirmed
Timelines may change where the customer requests additional work, delays an approval or changes previously approved instructions.
Kilomarket will communicate any significant delay as soon as reasonably possible.
We are not responsible for delays caused by events outside our reasonable control, including power cuts, internet outages, equipment failure, illness, supplier delays, platform outages, transport disruption or shortages of materials.
7. Revisions, Changes and Approvals
The number of revisions included in a project will be stated in the quotation or proposal.
A revision means a reasonable adjustment to work already created within the approved brief. A new concept, major redesign, additional page, new function or change of direction may be treated as additional work.
Kilomarket will inform the customer before charging for work outside the agreed scope.
Approvals sent through WhatsApp, email or another agreed communication channel will be treated as written approval.
Before approving artwork or other work, the customer must carefully check:
- Names and spelling
- Telephone numbers and addresses
- Prices, dates and quantities
- Colours and dimensions
- Images, logos and layout
- Website content, links and functions
Once the customer approves final artwork, Kilomarket may proceed with production, printing or publication.
Kilomarket is not responsible for an error that appeared in an approved proof where the final product matches that proof. If the final product differs materially from the approved proof because of Kilomarket’s error, we will provide an appropriate correction, reprint or other remedy.
8. Graphic Design and Branding
Kilomarket retains ownership of its general knowledge, working methods, design systems, templates, processes and pre-existing materials.
The customer retains ownership of material they supplied to Kilomarket.
After full payment, the customer receives the agreed rights to use the final approved design for the purpose for which it was created.
For a bespoke logo or brand identity, Kilomarket assigns its copyright in the final approved original artwork to the customer after full payment, to the extent that Kilomarket is legally able to do so.
This transfer does not include:
- Rejected or unused concepts
- Kilomarket templates or pre-existing materials
- Fonts, stock images or other licensed third-party materials
- Editable working files or source files unless specifically included
- Software, plugins or other materials governed by separate licences
Editable files, source files, design working files and alternative concepts are not automatically included. They will be supplied only where the quotation expressly includes them or where a separate fee is agreed.
Kilomarket may display non-confidential completed work in its portfolio, website, social media pages and marketing materials. A customer who requires confidentiality should notify us in writing before publication.
9. Printing and Physical Products
Custom printing begins after payment, final artwork approval and confirmation that the required material is available.
Colours displayed on a phone or computer screen may differ slightly from printed colours. Reasonable variations may also occur between different printers, materials, batches and production methods.
Minor variations in trimming, placement, colour, size or quantity that fall within reasonable production tolerances will not normally be considered defects.
If a required material is unavailable, Kilomarket will discuss any material substitution or significant change with the customer before proceeding.
Custom-printed products cannot normally be cancelled or returned because of a change of mind after production has begun. This does not remove the customer’s rights where the goods are defective, materially different from the approved proof or not supplied as agreed.
Risk in physical products passes to the customer when the order is collected or accepted on delivery.
The customer should inspect the order promptly and report any apparent production problem as soon as reasonably possible, together with photographs or other supporting information.
10. Website Design and Development
A website project includes only the pages, features and services listed in the quotation.
The customer is responsible for supplying accurate website content unless content creation is included in the quotation.
Websites will be designed to function on reasonably current versions of commonly used browsers and devices. Kilomarket cannot guarantee identical appearance on every device, browser or screen size.
Third-party themes, plugins, payment systems, maps, social platforms and other external services are governed by their own terms and may change, become unavailable or introduce additional charges.
Kilomarket does not guarantee a particular search-engine position, number of visitors, sales level or business result unless a specific written performance commitment has been agreed.
After full payment and approval, Kilomarket will provide the agreed website access or handover. The customer is responsible for protecting passwords and controlling who has access after handover.
Ongoing maintenance, content updates, security monitoring, backups and technical support are not included unless stated in the quotation or covered by an active maintenance or hosting plan.
Kilomarket will correct faults caused by its own work that prevent an agreed feature from operating as specified. This does not cover problems caused by customer changes, third-party updates, expired licences, malware, unsupported software or services outside the original scope.
11. Domains, Hosting and Business Email
Hosting and business email services may be provided through Kilohost using third-party infrastructure.
Hosting and domain fees are normally paid in advance for the stated billing period.
The customer is responsible for paying renewal invoices by the due date. Failure to pay may result in suspension, expiry or loss of the affected website, domain or email service.
Expired domains may attract third-party restoration or recovery fees. Kilomarket cannot guarantee that an expired domain will remain available for renewal.
Subject to full payment and applicable registry rules, Kilomarket will reasonably assist a customer who wants to transfer their domain or hosting service.
We take reasonable measures to maintain hosting services and backups, but we do not guarantee uninterrupted service or permanent recovery of every file or email. Customers should keep independent copies of important website content, emails and business data.
Hosting must not be used for spam, fraud, malware, copyright infringement, illegal content, attacks on other systems or activities that place an unreasonable burden on the server.
Kilomarket may suspend a hosting account where necessary to address non-payment, illegal activity, a serious security risk or misuse of server resources. Where reasonably possible, we will notify the customer and allow an opportunity to correct the problem.
Data remaining on an expired or terminated hosting account may be permanently deleted after reasonable notice. Customers are responsible for requesting and keeping any required backups before termination.
13. Cancellation and Refunds
Nothing in this section removes any cancellation, refund or other right provided by Zimbabwean law.
If a customer cancels before work begins, Kilomarket will refund the amount not already committed to non-refundable third-party costs.
If cancellation occurs after work has begun, Kilomarket may retain a reasonable amount for work already completed and costs already incurred. Any unused balance will be refunded where applicable.
A deposit is not automatically forfeited in every situation. The amount retained will reflect the work completed, time reserved and reasonable non-recoverable expenses.
Printing cannot normally be cancelled after approved artwork has entered production.
Domain registration, hosting renewal, advertising spend, licences, materials and other third-party costs may not be refundable once purchased or committed.
Monthly social media services may be cancelled before the next billing period, subject to any minimum period stated in the quotation. Work already delivered and advertising funds already committed will not normally be refundable.
If Kilomarket cannot provide an agreed service, we will offer an appropriate correction, replacement, service credit or refund for the affected portion.
Kilomarket may cancel or pause work where a customer fails to pay, repeatedly fails to provide required information, behaves abusively or requests unlawful work. We will account fairly for work completed and any unused amount paid.
14. Service Quality and Complaints
Kilomarket will perform its services with reasonable care and skill.
If you believe work is defective or materially different from what was agreed, contact us promptly with your order details, an explanation of the problem and any relevant photographs or documents.
We will assess the complaint and, where appropriate, provide a correction, replacement, reprint, service credit or refund.
A remedy will depend on the nature of the service, the work already completed, the approved proof and the requirements of applicable law.
15. Limitation of Liability
Kilomarket is responsible for direct loss caused by its breach of an agreement or failure to exercise reasonable care and skill, subject to applicable law.
To the fullest extent permitted by law, Kilomarket will not be responsible for indirect or consequential losses such as lost profits, lost opportunities, loss of expected sales or reputational damage that could not reasonably have been anticipated when the order was accepted.
Where permitted by law, Kilomarket’s total liability for a claim will be limited to the amount paid for the specific service that caused the claim.
This limitation does not apply where liability cannot legally be limited, including liability arising from fraud, deliberate misconduct, gross negligence or statutory consumer rights.
Kilomarket is not responsible for losses caused by inaccurate customer instructions, customer-approved errors, third-party platform failures, expired third-party services, unauthorised customer changes or events outside our reasonable control.
16. Website Use
The content on the Kilomarket website is provided for general information about our services.
You may not:
- Attempt to gain unauthorised access to the website or its systems
- Introduce viruses, malware or other harmful code
- Copy or commercially exploit Kilomarket content without permission
- Use the website for fraud, abuse or unlawful activity
- Misrepresent your identity or relationship with Kilomarket
Our website may contain links, embeds or content from third-party services. Kilomarket is not responsible for the availability, security or content of websites operated by third parties.
17. Privacy and Confidentiality
Personal information is handled in accordance with our Privacy Policy.
Information about cookies is available in our Cookie Policy.
Both parties should protect confidential business information received during a project and use it only for providing or receiving the agreed services.
Kilomarket may share necessary information with employees, contractors, hosting providers, printers and other service providers involved in completing the order. We will only share information reasonably required for that purpose.
18. Communications
The customer agrees that project instructions, approvals, quotations, invoices and notices may be communicated electronically through email, WhatsApp or another agreed channel.
The customer must keep their contact information current.
Messages sent from the customer’s supplied email address, telephone number or authorised representative may be treated as valid project instructions.
19. Governing Law and Disputes
These Terms and all Kilomarket service agreements are governed by the laws of Zimbabwe.
If a dispute arises, both parties should first attempt to resolve it through direct, good-faith communication.
A customer may submit a written complaint using the contact information below. Kilomarket will review the complaint and respond within a reasonable time.
If the dispute cannot be resolved directly, either party may pursue mediation, another mutually agreed dispute-resolution process or relief through a competent court in Zimbabwe.
Nothing in these Terms prevents a consumer from approaching the Consumer Protection Commission or exercising any other right available under Zimbabwean law.
20. Changes to These Terms
Kilomarket may update these Terms when its services, processes or legal obligations change.
The updated version will be published on this page with a revised “Last updated” date.
Changes will apply to future website use and future orders. They will not materially change an already accepted project unless the customer agrees or the change is required by law.
21. General Provisions
These Terms, together with the applicable quotation, proposal, invoice and referenced policies, form the agreement between Kilomarket and the customer.
If one provision is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
A delay or failure by either party to enforce a right does not mean that the right has been waived.
Neither party may transfer a project agreement to another person without the other party’s written consent, except where Kilomarket uses employees, contractors or specialist providers to complete the agreed work.

12. Social Media Services
Social media management services may be provided under SAKA according to the agreed monthly package or campaign quotation.
The customer remains the owner of their social media accounts and must provide the access and information required to deliver the service.
Content quantities, platforms, posting frequency, response management, advertising and other deliverables will be limited to what is included in the agreed package.
The customer is responsible for the accuracy and legality of business claims, prices, offers and information supplied for publication.
Advertising budgets and platform charges are separate from management fees unless expressly included. Advertising money must normally be paid before a campaign is launched. Funds already paid to an advertising platform may be non-refundable unless the platform issues a refund.
Kilomarket and SAKA do not guarantee a particular number of followers, enquiries, sales, views or engagements. Results depend on the customer’s offer, budget, audience, competition, platform systems and other factors outside our control.
We are not responsible for platform outages, policy changes, rejected adverts, account restrictions or suspensions that were not caused by our negligence or misconduct.
